KroyTech™ LLC dba KroyTech Workbenches is an authorized distributor and representative for BenchPro, Inc. and Bench Depot, a division of BenchPro. The following terms and conditions apply to workbench orders placed through KroyTech.

PAYMENT POLICIES

Payment

We take Visa, MasterCard, company check or wire transfer/direct deposit. Charges will appear on your credit card as KroyTech Workbenches or Bench Depot (a division of BenchPro). Benches are made-to-order. Therefore we charge your credit when you place your order.

Credit Terms

Payment terms are available for on large orders from established businesses upon approval and receipt of a company purchase order.

Late Payment

Your invoice will be issued and sent at time of shipment. We give you the lowest discounted prices possible. Payment on terms must be received by the invoice due date, 30 days from the invoice date for Net 30. We charge 1.5% per month on late payments to recover our own banking fees incurred to carry outstanding balances.

We increase our sale price slightly to customers who repeatedly pay late in order to cover our costs. However, our prices still remain lower than any other distributor.
 

ORDER CANCELLATION OR CHANGES

Products are made to order. Once the order is placed, you must notify KroyTech within 24 hours to cancel or make changes. After that, the manufacturing process has begun. Your order cannot be cancelled or returned without a restocking charge of up to 30% and up to 75% of the cost of custom made items or accessories.
 

SHIPPING

Drop Shipped

Orders are drop shipped from the BenchPro warehouse FOB Tecate, California (San Diego County).

Packaging

Workbenches are packaged flat ("knocked down") in 6" high cartons. The individual boxes are strapped to standard size pallets. (Pre-assembly is available, but costs extra and increases freight charges significantly.)

Freight Charges

Our manufacturer, BenchPro uses several different carriers. Because of the instability of fuel prices, carriers cannot hold prices quoted for more than a few days. Your FINAL FREIGHT CHARGE at the time your product ships may change up to 7%. We pass on the carrier's charges. We do not add a markup or "handling charge".

RETURN POLICIES

Errors on Your Order

All products are made to order. When you place an order, an order confirmation will be emailed to you. Please check your order confirmation carefully to insure that it is correct. Any corrections or changes to the order must be called or emailed in to KroyTech immediately. Once the manufacturing process has begun the order or items in the order cannot be cancelled or returned without a restocking charge of up to 30%. Custom made products cannot be returned. Custom means any item, workbench or modification requested by the buyer which is not listed on BenchPro's (the manufacturer's) website at www.benchdepot.com or non-standard color.

Defective Products

Defective products or missing items will be replaced immediately and rush shipped at no charge as soon as BenchPro can make them. No products are to be returned without prior written approval and receiving of shipping instructions from KroyTech or BenchPro.

Non-Defective Products

We have a very high rate of customer satisfaction with BenchPro's workbench products. Quality is unsurpassed, and at KroyTech we go out of our way to make sure our customers are extremely happy with their orders. Because products are made to order the manufacturer cannot take non-defective products back without charging a restocking fee. Most orders can be returned within 15 days of receipt upon written approval from BenchPro. There will be a restocking charge of up to 30% on all non-defective products returned. Custom made benches and accessories cannot be returned.

MANUFACTURER'S RETURN POLICIES

BenchPro™ will either refund the entire purchase price including freight and tax (if any) or replace the product or component that is defective, and pay for the freight.

Product Returns:

As we make all orders from base materials, we charge a "restocking charge" on unneeded products. We also charge a restocking charge for products ordered but cancelled after the product is built. This is to cover our repackaging and handling. Customers pay the cost of return freight. We do not accept returns on used products.

Restocking charge schedule (Unused products only):
A. Kennedy, Roosevelt Series in standard sizes and colors will be charged 15%.
B. Dewey, Harding, Jefferson, Grant and Adams Series in standard sizes and colors will be charged 30% restocking charge.
C. Any bench in a custom size or color will be charged up to 75% restocking charge, as we will have a difficult time reselling them.
D. Custom and non-catalogue items are non-returnable.
E. No product shall be returned after 90 days.

No return of defective product is ever required. (We may ask for an electronic photo in cases where we have not seen the problem before).

From the lawyers: In no case shall BenchPro™, its distributors, employees, related divisions, and other entities be responsible for any direct, consequential or indirect damage caused by the use, inability to use, or incorrect use of our products. Our liability shall be limited to replacement of product or a full refund.

Litigation: All claims and/or disputes relating to the sale, quality and/or use of our products are to be settled by binding arbitration in the state of California, county of San Diego or any other location mutually agreeable to both parties.

The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys’ fees, for which the loosing party shall repay the prevailing party.

Any such arbitration shall be conducted by an independent arbitrator experienced in wholesale/retail distribution. An award of arbitration may be confirmed in a court of competent jurisdiction.

Defective Product Destruction: Dangerous products should not be put into open waste disposal system until they have been made unusable, so no third party can claim them and be injured.

Product Returns:

1. No return is ever required. (We may ask for an electronic photo in cases where we have not seen the problem before).
2. If the product is purchased but not needed, and returned with freight prepaid, and in new condition with original packing materials, we charge a restocking charge. We also charge a restocking charge for products ordered but cancelled after the product is built. (This is to cover our repackaging, reselling and handling).

 
SHIPPING DAMAGE

Most customer orders are problem free. However, problems do occasionally occur. The following paragraphs are instructions on what to do should you have problems upon receipt of your workbenches.

Product becomes the property of the buyer upon being loaded FOB Tecate, CA and is the responsibility of the carrier. We go the extra mile to get you replacement parts quickly if there is any damage in transit. The following procedure enables us to send replacement parts if there is freight damage.

FREIGHT CARRIER WARNING -- INSPECT UPON ARRIVAL

Any suspected shipping damage must be documented by you upon receipt before the driver leaves so that we can send you replacement parts. Damage is not frequent (about 1%), but it does happen.
Replacement parts will be sent to you expedited above all other orders.

1. WHEN THE PRODUCT ARRIVES,
YOUR RECEIVING PERSON(S) MUST NOT SIGN THE CARRIER'S BILL OF LADING BEFORE INSPECTING THE SHIPMENT FOR TEARS AND COMPRESSIONS IN THE PACKING. OPEN UP AREAS OF THE PACKAGING WHICH SHOW POSSIBLE DAMAGE. WRITE "DAMAGED" DIAGONALLY ACROSS THE DRIVER'S BILL OF LADING IF ANY DAMAGE IS FOUND. HAVE THE DRIVER WAIT IF NECESSARY WHILE YOU INSPECT YOUR ORDER. DO NOT LET HIM/HER PRESSURE YOU WHILE YOU INSPECT.

2. Send digital photos of any damaged cartons and parts to KroyTech within 21 days of receipt. We will forward them to BenchPro. They will file a damage claim for you -- if you used their carrier. BenchPro will give your replacements top priority and send them to you at no charge.

It is OK to reject the entire shipment for damage. We prefer you to accept the shipment and wait for replacements if the damage is not too extensive, so you can use the products that are OK.

Following this procedure covers you completely against having to pay for products damaged by the carriers. It is not necessary to return any freight-damaged items or products. They become the property of the carrier. After a claim is filed on your behalf, the carrier will sometimes come to inspect and/or take possession of the damaged items.
 

PRICE AND PRODUCT CHANGES

KroyTech Workbenches reserves the right to make changes in products and prices at any time and is not responsible for errors in prices listed on the website.

DISCLAIMER

All statements, recommendations, and technical information contained in BenchPro or KroyTech advertising and/or stated by KroyTech Workbenches are based on information and/or tests we believe to be reliable. The accuracy or completeness thereof is not guaranteed.

Before purchasing workbench products for specialty applications, the user is requested to determine the suitability of the products for their application. We assume no risk or liability therein.

Neither KroyTech Workbenches nor BenchPro shall not be liable for injury resulting from defective units which remain in service after the user is aware of a defect which an average person would determine could ultimately result in injury.

Neither KroyTech Workbenches nor BenchPro will be liable for loss or damage, direct, indirect, or consequential, arising out of the use of, or inability to use their products. Their only obligation is the replacement or repair of parts, or complete units proven to be defective, as outlined in the manufacturer's Workbench warranty page and Chair warranty page.
 

LEGAL INFO

In the event that there is litigation between KroyTech, LLC and any other party, jurisdiction will reside in the state of Florida, Broward county.

If a collection agent is secured in order to collect moneys for invoices which are past due, KroyTech shall be entitled to recover any and all expenses related to such collection.

If litigation is instituted by KroyTech to facilitate collection of moneys for invoices which are past due, the party to the litigation which loses shall pay the attorney's fees, court costs and expenses for the prevailing party.
